我在海淀区工作多年,曾任试验区工委书记、海淀区区委书记,对中关村电子一条街的科技公司、北京市新技术产业开发试验区有着深厚的感情,并在工作中倾注我全部的心血。明年是海淀试验区成立二十周年,海淀试验区从我国改革开放的一块问路石,已经蜕变为美丽的中关村园区,成为我国和世界著名的科技园区。联想、新浪、百度等一大批高科技公司也成为闻名于海内外的知名企业。
回顾中关村电子一条街和海淀区试验区成长的过程，让人思絮万千，特别是1990年6月14日，在海淀爆发的全国最大的走私案–信通公司走私案,让我至今记忆犹新。这个走私案不仅仅是涉及到信通公司,如果处理不好，由信通公司走私案引发的贷款互保等等一系列问题，将使中关村许多公司倒闭,给刚刚起步的海淀区试验区带来一场灾难。今天,我将亲身经历的海淀区委、区政府妥善处理信通公司走私案，使海淀试验区平稳度过这场灾难的一些事情写出,以史为鉴 让人明晰。

第一节 信通公司走私案是怎么回事
对于中关村信通公司走私案,外界流传不少的"版本",有人说, 走私案的暴露是因为集装箱里有毒品海洛因。有人说，走私案的暴露是因为集装箱里装有枪支。其实,这些都是人们的猜测。我在处理信通公司走私案的过程中了解到有关事实,把真相告诉大家。
o走私案的金额与人员
据北京海关调查，信通公司1990年6月开始走私，1991年6月14日被查获。这期间信通公司共走私12次，走私物品涉及金额7269.5万余元。信通公司走私案因数额巨大,成为当时建国以来最大的走私案。
北京海关查获信通公司最后一次的走私物品，价值2843.3万余元。
信通公司走私案因内部职工揭发被查获，信通公司走私案还是信通公司人员与海关内部人员互相勾结形成的。
o走私案的走私手段
信通公司走私案由信通公司副总裁、香港信通电脑公司经理高剑宇在香港打前站,他与香港康美公司总经理王锡康合谋,利用王锡康为内蒙古呼和浩特市电子设备厂进口打印机壳的批文,采用偷梁换柱的手段,在集装箱里装进计算机、打印机整机、医用B超机整机等。这些集装箱分别从天津和北京进关，在路过北京，向内蒙古二连呼和浩特海关转关的时候,信通公司将集装箱拉到公司租用的仓库，开箱取出走私货物，再把打印机的机壳重新装箱运往内蒙古应付海关查验。
因为集装箱锁上的铅封是海关特制的,所以铅封的打开和重新封口，必须有海关内部人的参与,否则信通公司的走私不会成功。
信通公司走私案涉及的人员有，信通公司总裁金燕静、副总裁高剑宇、信通公司经营部经理吕进中、信通公司应用电子公司经理金永生和香港商人王锡康。
副总裁高剑宇在香港得知消息后逃往国外,至今没有回国，他今年也快70岁了。金燕静被判有期徒刑8年,其余4人也被判刑。
第二节 信通走私案可能成为中关村的一场大劫难
为什么说信通公司走私案会成为中关村和试验区高科技企业的大劫难？因为这个案子会给中关村不少的高科技企业带来灭顶之灾，我在处理这个案件时深深感到这一点。
o信通贷款互保能使中关村公司大批倒闭
信通公司最后一次的走私物品价值2843.3万元，也就是说信通公司最少要拿出2843多万元购买走私货物，信通公司本身没有这么多的资金,全是银行的贷款。信通公司在贷款时使用的是互保的办法。互保就是信通公司在贷款时由科海公司担保，科海公司贷款时由信通公司担保。
科海公司当时为信通公司贷款担保有100万美元和400万元人民币。还有其他公司为信通公司贷款担保，总额为2000多万元。
更可怕的是,信通公司和科海公司在互保的情况下,又与希望、联想等多家公司形成互保贷款。希望、联想等多家公司又与其他多家公司形成互保贷款。信通公司因走私被查处，无法归还两千多万元的银行贷款，科海公司就要马上为信通公司归还银行贷款100万美元和400万元人民币。如果银行强要这笔巨额贷款，科海公司就会为这次的互保而倒闭。如果科海公司倒闭,为科海做银行贷款互保的其他公司同样也会倒闭。
再为可怕的是,信通公司因走私被查处倒闭，失去为其他公司担保贷款的资格。凡是由信通公司担保的贷款,都可能成为不良贷款收不回来。所以，银行会立即向信通公司担保的贷款公司提前追缴贷款,这些公司也会因提前归还贷款或无法归还贷款而倒闭。
信通公司走私案引发出的银行贷款互保风波如果爆发,初步估计能使不少中关村大公司倒闭。如果这样，中关村电子一条街和海淀试验区,几年内都不可能恢复原气。
o对走私案的重罚使中关村许多公司不寒而栗
信通公司走私案爆发后,还会引发海关方面对信通公司的处罚,就是以走私货物同等价值计算,也会有近亿元的罚款。
海关还会对购买信通公司走私货物的公司进行调查,因为有关法律规定:明知是走私物品,还进行购买和倒卖的公司,一同视为走私,并加以处罚。这种情况，让中关村许多购买过信通公司走私货物的公司不寒而栗。
联想投资公司总裁柳传志，在谈到信通公司走私案时，他说:"当年信通公司走私案爆发后，对中关村许多公司包括联想公司震动很大。联想公司和这些公司都与信通公司发生过交易,如果被海关认定为明知是走私物品还进行购买和倒卖的公司，海关就要重罚,这些公司因交不起罚款只好倒闭。北京市、海淀区、试验区的领导，对信通公司走私案的处理非常好,使中关村不少公司免于灾难。
第三节 海淀区委是如何处理信通走私案
o连夜召开会议处理信通走私案
1991年6月15日晚, 海淀区委正在开会研究别的工作，得知信通公司走私案的消息后，大家感到非常震惊，立即改变议题紧急讨论对这起走私案的处理工作，会议开到深夜1点多才结束。最后决定成立信通公司走私案处理小组,成员有我,我当时任海淀区委副书记、试验区书记。还有试验区主任胡昭广，试验区工委书记曹永训。后来中科院科技开发局局长张宏同志，也参加到走私案的处理工作中来。因为案情重大,海淀区区委、区政府上报北京市政府，北京市政府又上报到中央。
不久,时任国务院总理的李鹏同志，对信通公司走私案做出非常严厉的批示。当时的国务院秘书长罗干同志，当时的北京市委副书记、市政法委书记李其炎同志，也参与信通走私案的处理工作。罗干和李其炎同志，在处理信通公司走私案的问题上，不仅坚持依法办事,还以中关村科技企业发展的大局为重，稳妥的处理走私案。
当时的中共中央政治局委员、北京市委书记李锡铭同志，非常爱护中关村科技企业,在处理信通公司走私案问题上，对中关村科技企业起到很好的保护作用。海淀区区委、区政府、试验区主要采取了以下措施处理信通公司走私案。
o科海代管信通防止信通公司倒闭
海淀区区委有关信通公司走私案的会议结束时,已经是深夜1点多,我打电话把科海公司总裁陈庆振找来,让他全面接管信通公司。这样做是防止信通公司倒闭,如果信通公司倒闭,银行马上会向为信通公司担保贷款的中关村各公司追要贷款。向信通公司为其贷款的公司追要贷款，就会使中关村发生一连串的公司倒闭。
科海公司虽然为信通公司担保贷款有1400多万元,但是总裁陈庆振深知信通公司走私贷款和罚款的金额,最少还需要3000多万元。对信通公司这个空壳公司他是不愿接手的。
他对我说:"信通公司没有值钱的东西了，我给信通公司赔上1000多万元没关系，如果把它接过来，它那个窟窿我可能再拿出3000万也填不满。我不能接管信通公司。"
我代表区委给陈庆振做工作,对他说:"老陈，不要求你把信通公司起死回生，你只需要保持信通公司的牌子不倒，就是一个"僵尸"也得挺在那儿不能倒下来!为什么要这样做？因为信通公司欠银行大量贷款,还为其他公司担保大量贷款,如果信通公司倒闭,全造成大批公司倒闭。如果信通公司不倒，我们还可以想别的办法，请你顾全大局。"
后来,中科院的张宏同志也找陈庆振谈话,让他顾全大局，接管信通公司。
陈庆振不愧是老同志，最后终于以代管的形式管理信通公司。还以最快的速度和信通公司三个股东，中科院计算所、中科院科仪厂、海淀农工商总公司的负责人签订代管协议，派人进驻信通公司，使信通公司平稳地运行很长一段时间。
科海公司最后还是为代管信通公司付出惨重的代价,为信通公司代还工商银行400万元贷款。中国银行的100万美元贷款，由于中国银行出现贷款的监管失误,科海公司进行诉讼才免于代还。
o贷款挂帐付息防止发生公司连环倒闭
经过调查,信通公司最后这次走私，向银行申请2000多万贷款。再加上信通公司走私案引发的其它债务和海关处罚款项, 信通公司需要拿出大批资金。1990年,信通公司全年的纯利润仅为150多万元,肯定拿不出来这么多的钱来。银行就会向信通公司的互保公司科海公司要钱，强行划款。最后中关村的公司如同多米诺骨牌，一个接一个地倒下去。
为保全大局，海淀区区委、区政府、试验区的领导,向相关的银行负责人做了大量的工作,使信通公司欠银行的贷款以缓还、挂帐付息等多种方式解决。信通公司为其他公司所担保的贷款也应视为有效，避免了一场危机。在这方面,试验区的曹永训和王晓龙同志作了大量的工作。
o把信通与中关村公司分开防止扩大化
对中关村电子一条街本身,不少人有不同的看法,有人称为"骗子一条街"、"走私一条街"、"倒爷一条街"，信通公司走私案发生后正好授人以柄。否定中关村电子一条街,清查所有中关村公司走私问题的呼声很高，来自各个方面的都有，这使海淀区在处理信通公司走私案时很棘手。海淀区区委、区政府、试验区的领导,为保护中关村科技企业据理力争，并表明自己的态度。
区领导做出决定,决定指出:"信通公司走私案不仅仅是信通公司偷逃税款为获得暴利的问题，是侵犯国家外贸权的大是大非的问题，必须严肃处理。但是，清查信通公司走私案的问题时,不要涉及中关村其它企业,要把信通公司与中关村企业分开。"这项决定及时向中关村各个企业进行了传达，避免在中关村引起恐慌。
我认为:当时的这项决定非常好,假如将信通公司走私案扩大化,不要说查中关村公司走私,就是查购买进口批文、非法购买外汇额度和套汇的事情,就能查倒不少公司。为什么这样讲?因为在20世纪80年代中期到90年代初,中国的计算机工业是一片空白，无论是整机还是各种芯片、硬盘、5寸的软磁盘，甚至打印机的色带都需要进口。当年国家对进口计算机产品计算机配件管制得很严格，公司要有国家批准进口的文件才能获得进口权。这种文件就叫批文，这些批文往往在一些部委和他们下属的大型国有企业手中。
中关村公司在研制和生产高科技产品中，需要大量的计算机和计算机配件，虽然中关村公司是改革中的新生事物,可是他们还不是国家正规企业,没有资格得到国家正式批文。只好用钱向有权势的部委和国有企业买进批文，几张纸的批文可以卖到上万、十几万、上百万元。即使中关村公司买到批文,他们还要买外汇额度,当年国家对外汇也管得非常紧,企业用外汇要向国家申请使用外汇额度,有国家批准的外汇额度，银行才卖给企业外汇。有外汇额度的单位和企业在使不完的情况下就向外出售。中关村有的公司向这些单位购买外汇额度，实在买不到外汇额度，就到"黑市"高价换取外汇，再从国外进口公司科研必需的计算机和相关配件。
中关村公司这种买批文、套取外汇进口计算机和相关配件的行为,全部都是违法行为也可称之为走私。但是从另一个角度讲，中关村公司正是用这种办法推出高科技产品，不仅填补我国的高科技产品的空白，也有效地打破了相关洋货对我国市场的垄断,为国家节约了大量的外汇。他们这样做是无奈之举，应该理解这些企业，所以不能把信通公司走私与中关村公司一概而论。
为了让中关村各公司,从信通走私事件中吸取教训,海淀区区委、区政府、试验区的领导还多次召开高科技公司负责人大会，多次向他们讲明走私的危害性,要求全区各高科技公司要以信通走私事件为戒,规范公司的行为,遵守国家法纪。
信通走私案从爆发到处理完毕，用了几乎一年的时间, 我和同事们度过了许多不眠之夜, 终于妥善平稳地处理好信通走私案，使试验区和科技企业的发展没有受到影响。
